Tim, I have not had this happen at upper speeds, but I have had it happen when coming to a stop and it won't shift into first gear. I'm not sure why this happens (it's not often). I would suggest you vary your downshifting speeds from when you normally downshift. Maybe the drive gear is still spinning too fast to mesh with forth gear. Also I have heard (not fact) that runnung synthetic blend or full synthetic oil will improve shifting. Synthetics are much more expensive than regular oil and use only motorcycle approved full synthetic since full synthetics are so slick that it will cause your clutch to slip.
